Terms of Service
Last updated: October 2026
These terms are an agreement between you and VixScale Technologies(“VixScale”, “we”, “us”). They cover this website, VixSync — the customer conversations platform we build and run at vixsync.vixscale.com — and our services. By creating a VixSync account or using our services you accept them on behalf of your business, and confirm you are authorised to do so.
This website
The content of this website is general information about our services and products. We keep it accurate and current, but it is not a binding offer; commercial terms are set per engagement in a written proposal, order or contract.
Engagements
Services — including ERP, CRM, AI, software and marketing engagements — are governed by the written agreement signed for that engagement, including scope, deliverables, pricing, support and service levels. Where these terms and a signed agreement differ, the signed agreement prevails.
VixSync accounts
- Give accurate details and keep them current. Each person needs their own login; don’t share accounts.
- Keep your password private and turn on two-step sign-in. You are responsible for what happens under your account; tell us straight away if you suspect it has been misused.
- The workspace owner decides who joins and what role they have, and approves or refuses any request from VixScale staff to open the workspace for support.
- VixSync is for businesses. You must be at least 18.
Your data and your customers' data
Your business owns the data it puts in VixSync — contacts, conversations, knowledge base, files. We use it only to provide VixSync to you, as set out in our Data Processing Agreement, which forms part of these terms, and our Privacy Policy.
For your customers’ personal data you are the data fiduciary under India’s Digital Personal Data Protection Act, 2023. You are responsible for having a lawful basis to collect it and contact them — including their consent to receive WhatsApp messages, emails and calls — for giving them notice of how you use it, and for answering their requests. VixSync gives you the tools: opt-out handling, unsubscribe links, contact deletion and data export.
Messaging rules
When you message people through VixSync you must follow our Acceptable Use Policy, the WhatsApp Business Messaging and Commerce Policies, Meta’s Platform Terms, and Indian law, including TRAI’s rules on commercial communications. In particular: start WhatsApp conversations only with approved templates and only with people who opted in, and stop as soon as someone opts out. Meta, messaging and email providers may limit or block numbers and domains that break their rules; that is outside our control and not a fault in VixSync.
AI features
VixSync’s assistants answer from the knowledge base you give them, but AI can be wrong. Review what your assistant says, keep its knowledge current, and don’t rely on it for medical, legal or financial advice. You can take over any conversation, and your customers can always ask for a person.
Plans, wallet and payment
Plans, usage limits and prices are shown in your VixSync account before you pay. Fees are billed in advance and include GST where it applies. Messaging and call charges are deducted from your prepaid wallet at the rates shown in your account; WhatsApp conversation charges set by Meta can change, and we pass those changes on. If a payment fails, the workspace becomes read-only after a grace period until it is paid. Refunds follow our Refunds & Cancellation policy.
Availability and changes
We work to keep VixSync available and secure, and plan maintenance for quiet hours. Unless a signed agreement gives a service level, VixSync is provided “as is”, and some features depend on third parties — Meta, AI, email and phone networks — whose outages we can’t control. We improve VixSync continually; if we remove a feature you pay for, we tell you in advance.
Suspension and closing your account
- You can close your workspace at any time in Account settings, and export its data first. Everything is permanently deleted 30 days after closure, except invoices we must keep by law.
- We may suspend a workspace, after notice where possible, if it is used to break these terms or the law, puts other users or our providers at risk, or stays unpaid. We restore it once the issue is fixed.
Intellectual property
The VixScale and VixSync names, logos, software and the content of this website belong to VixScale Technologies. You get a non-exclusive right to use VixSync for your business while your account is active. Don’t copy, resell, reverse engineer or probe VixSync, except for security research reported to us as set out on our Security page. Ownership of client work in an engagement is set in that engagement’s agreement.
Liability
To the extent the law allows, neither side is liable for indirect or consequential loss (such as lost profit or business), and our total liability for any claim about VixSync is limited to the fees you paid us for it in the 12 months before the claim. Nothing limits liability that the law does not allow to be limited. You will compensate us for claims arising from content you send through VixSync or from messaging people without their consent.
Changes, law and disputes
We may update these terms; we change the date above and email account holders about significant changes before they take effect. These terms are governed by the laws of India, and the courts of Gurugram, Haryana have jurisdiction. We’d rather solve problems first — write to us and we’ll respond within 7 working days.
